H.B. 717 - Hawaii Kratom Consumer Protection Act

• Requires all kratom products sold in Hawaii to be registered with the Department of Health beginning January 1, 2026, with registration fees determined by departmental rules.

• Prohibits kratom products containing more than 2% 7-hydroxymitragynine alkaloid composition, dangerous psychoactive compounds, residual solvents exceeding U.S. Pharmacopeia standards, synthesized materials, or products attractive to children.

• Mandates comprehensive labeling requirements including warnings against use by minors, pregnant/breastfeeding individuals; statements that kratom may be habit-forming; recommended serving sizes and daily limits; and listings of alkaloid content.

• Establishes criminal penalties including misdemeanor charges for selling kratom to minors and class C felonies for products containing controlled substances or synthesized kratom alkaloids.

• Allows federal regulations from the Drug Enforcement Administration or Food and Drug Administration regarding kratom or its derivatives to supersede state law provisions.
