HB 809 Summary

• Allows bidders on public works construction projects to clarify or correct immaterial or technical information in subcontractor listings for up to 24 hours after the bid submission deadline, in addition to existing correction procedures.

• Requires construction bids to be opened no sooner than 24 hours after the bid submission deadline.

• Defines "immaterial or technical information" to include irregularities that do not affect substance, inconsequential variations not prejudicial to other vendors, missing signatures, typographical errors, and listed subcontractors whose licenses were temporarily suspended but reinstated by award time; excludes the identity of subcontractors.

• Applies for five years; repeals June 30, 2027, and restores prior procurement law.

• Purpose is to reduce bid protests, costs, and delays resulting from technical errors in subcontractor listings.
