H.B. 810 Summary

• Adds a new section to Hawaii Revised Statutes Chapter 342F establishing a private right of action for persons aggrieved by helicopter violations of the Federal Aviation Act and existing federal laws.

• Allows aggrieved persons to sue helicopter owners or operators in district court to enjoin violations and recover three times actual damages or $1,000 per violation, whichever is greater.

• Entitles prevailing plaintiffs to recover court costs and reasonable attorney's fees.

• Exempts helicopters owned or operated by government agencies and those providing emergency services such as aeromedical services or search and rescue operations.

• Takes effect July 1, 3000.
