Property owners who receive a notice of violation for zoning ordinance violations and fail to remediate within the county planning or permitting agency's specified timeframe shall be assessed a minimum fine of $1,000 per day the violation persists.

If accumulated fines exceed $5,000, the notice of violation becomes a lien upon the real property within 30 days.

If the property owner does not satisfy the lien and commence remediation within 30 days of receiving notice of the lien, the county planning or permitting agency shall initiate foreclosure proceedings without delay.

The bill establishes a new section in Chapter 46 of the Hawaii Revised Statutes to codify these penalties for unaddressed zoning violations.

The Act takes effect upon approval and does not affect rights, duties, or proceedings that occurred before its effective date.
