• Amends Section 414D-155 to impose a standard negligence test on officers of condominium associations incorporated under chapter 414D, removing heightened legal protections previously available to nonprofit officers.

• Amends Section 414D-149 to impose a standard negligence test on directors of condominium associations incorporated under chapter 414D, removing heightened legal protections previously available to nonprofit directors.

• Officers and directors of condominium associations (subject to chapter 514B) must meet a reasonable person standard of care but are no longer entitled to rely on information from other officers, employees, or professionals without independent verification.

• Effective date is July 1, 2025, with no retroactive application to rights, duties, or proceedings that matured before the effective date.
