HB 877 Summary

• Prohibits erection, placement, construction, or maintenance of encampments (tents, makeshift shelters, or temporary structures used for habitation) within 100 feet of the property line of any pre-K-12 public or private school or school facility on public or private property.

• Violation of the encampment prohibition constitutes a petty misdemeanor, and does not preclude additional charges such as trespassing under chapter 708 or other violations.

• Authorizes the Department of Education, charter schools, and private schools to collaborate with law enforcement to identify and remove encampments within the buffer zone.

• Requires law enforcement personnel enforcing this section to provide displaced individuals with information about temporary housing and homelessness assistance programs and to take their personal belongings into custody for return upon release.

• Effective July 1, 3000.
