Expands the definition of "employee" under the Hawaii Employment Relations Act to include independent contractors and all individuals subject to the National Labor Relations Act, not just those over whom the National Labor Relations Board has declined to exercise jurisdiction.

Removes the exclusion of independent contractors from employee protections under state labor law.

Maintains existing exclusions for domestic service workers, family employees, executives, supervisors, and employers with fewer than two employees.

Applies to all individuals subject to federal National Labor Relations Act jurisdiction, removing the prior limitation to only those areas where the federal board declined jurisdiction.

Takes effect upon approval.
