HB 939 Summary

• Defines "low alcohol by volume spirits beverage" as any alcoholic beverage containing no more than 7% alcohol by volume, including distilled spirits mixed with other ingredients.

• Establishes a gallonage tax on low alcohol by volume spirits beverages at $0.93 per wine gallon, effective July 1, 2025.

• Increases small craft producer pub license manufacturing limits from 70,000 to 250,000 barrels of malt beverages, 20,000 to 100,000 barrels of wine, and 7,500 to 75,000 barrels of alcohol annually.

• Sunsets December 31, 2028, with sections 244D-4(a) and 281-31(r) reverting to their prior form.
