Limits attorneys' fees and costs in construction defect settlement agreements to a maximum of 25% of the recovery amount for plaintiffs' attorneys.

Limits attorneys' fees and costs awarded by courts in construction defect actions to a maximum of 25% of the recovery amount for prevailing plaintiffs.

Defines "construction defect" as any deficiency in or arising from the design, specifications, surveying, planning, construction, supervision, or observation of construction of a building or structure.

Does not apply to contracts existing before the effective date in a manner that violates the Hawaii State Constitution or the U.S. Constitution.

Takes effect on July 1, 3000.
