Authorizes the Board of Land and Natural Resources to issue a 25-year term, non-exclusive easement covering approximately 6,128 square feet of state submerged lands at Kahana, Lahaina, Maui for Hololani Resort Condominiums.

Permits removal of existing emergency sandbags installed in 2007 and construction of a rock revetment (steel sheet pile and sloped rock structure) to address shoreline erosion that threatened the 64-unit condominium project.

Project has completed lengthy permitting process with federal, state, and county approvals, including Conservation District Use Permit (May 2014) and Special Management Area Permit (July 2016), with at least nine public comment opportunities.

Hololani Resort Condominiums will pay fair market value for the easement as determined by independent appraisal and will provide public infrastructure improvements including a permanent public access stairway and storm drain protection.

Easement area must be finalized and approved by the Survey Division of the Department of Accounting and General Services; concurrent resolution required by HRS section 171-53 for leasing state submerged lands.
