S.B. 1028 Summary

• Prohibits assessment of any fees, fines, surcharges, court costs, or administrative costs against persons adjudicated for offenses committed before age 18, or against their parents or guardians.

• Voids all outstanding court-ordered fees, fines, and administrative costs previously imposed on minors for delinquency offenses, with reimbursement of any payments made toward such debt.

• Limits court-ordered community service for minors to a maximum of 72 hours and requires that such service not interfere with the minor's school or work commitments.

• Repeals sections 577-18, 577-23, and 577-24, which previously imposed penalties on parents and guardians allowing children in streets at night and persons escorting unmarried minors to dance halls.

• Eliminates various financial penalties in vehicle, DUI, and delinquency proceedings for juveniles, including driver education assessments, trauma system surcharges, restitution costs, and test reimbursements; effective July 1, 3000.
