S.B. 1057 Summary

• Amends Hawaii's bid incentive for public works contracts valued at $250,000 or more to require that both the bidder and all subcontractors be parties to registered apprenticeship agreements for all apprenticeable trades utilized on the project.

• Changes the incentive mechanism from a bid amount reduction to a five percent bid preference, with the lowest total bid (including preference) awarded the contract at the actual offered price.

• Requires bidders to provide written proof at bid submission that they and their subcontractors are parties to registered apprenticeship agreements; exempts trades for which no state-approved apprenticeship program exists.

• Establishes that if a contractor or subcontractor loses apprenticeship agreement status during construction, the governmental body may impose temporary or permanent work cessation, seek restitution or liquidated damages, declare default, or initiate debarment proceedings.

• Effective July 1, 2050.
