SB 1064 Summary

• Prohibits operating a medical cannabis dispensary or cultivating cannabis without a Department of Health license, with violations classified as a class C felony for unauthorized dispensary operation.

• Prohibits search platforms, web hosting services, social media platforms, and other entities from advertising cannabis sales by unlicensed persons or entities, unless they verified and reasonably relied on a valid license from the department.

• Establishes a cannabis cultivator license authorizing cultivation and distribution of cannabis plants and flower to dispensaries, with limits on the number of licenses issued, plant canopy size (indoor and outdoor), and maximum plant count per licensor.

• Requires the Department of Health to issue a cease and desist notice before initiating criminal proceedings against violators, and provides an affirmative defense for platform operators who requested and examined valid licenses before posting advertisements.

• Appropriates funds from the Medical Cannabis Registry and Regulation Special Fund to the Department of Attorney General for enforcement and mitigation of nuisances related to medical cannabis regulations, effective December 31, 2050.
