Prohibits individuals from being held liable in defamation actions for making truthful communications about sexual misconduct without malice.

Defendants who prevail in defamation actions brought against them for making protected communications are entitled to recover reasonable attorneys' fees and costs.

Defines "protected communication" as factual information related to sexual assault, sexual harassment, or sexual discrimination experienced by the person making the communication.

Covers sexual offenses under Hawaii Revised Statutes chapter 707 part V, sex-based discrimination under sections 378-2 and 515-3, and retaliation for reporting sexual misconduct.

Takes effect April 23, 2057.
