Requires all government contracts for performing government functions to expressly mandate that contractors retain records according to the agency's retention schedule and provide the agency access to all records subject to Hawaii's public records law (UIPA).

Adds new definitions to UIPA: "government function" means a service, program, or activity that an agency is authorized or required by law to perform; "trade secret" references the definition in section 482B-2.

Expands the definition of "government record" to include information created, received, maintained, or used by private contractors performing government functions on behalf of public agencies.

Prohibits agencies from denying public records requests for contractor records used in performing government functions based on trade secret or proprietary information claims, except where specifically protected by law.

Takes effect January 1, 2491.
