S.B. 1286 Summary

• Prohibits any person from collecting, sharing, selling, or offering to sell driver data recorded by motor vehicles without explicit written consent from the vehicle owner or lessee.

• Requires disclosure notifications for data collection to be provided in clear and conspicuous language, with consent required separately for each specific motor vehicle service.

• Denying consent for data collection cannot be used as grounds to refuse a service when additional data collection or sharing is not reasonably necessary for that service.

• Defines "clear and conspicuous" consent to require stand-alone disclosures with specific data categories, easy-to-understand language, and refusal options that are equally prominent as acceptance options.

• Takes effect July 1, 2050, and applies only to new motor vehicles sold or software updates for existing vehicles; does not apply to emergency response disclosures.
