SB 1298 Summary

• Expands the definition of "electronic device" subject to recycling requirements to include facsimile machines, videocassette recorders, portable digital music players, DVD players and recorders, household routers and modems, and electronic device peripherals such as keyboards, cords, power supplies, speakers, and video game consoles.

• Excludes manufacturers that produce only electronic device peripherals from the definition of "manufacturer" subject to the recycling program requirements.

• Changes the Department of Health's authority from "shall" to "may" determine additional penalties based on environmental impact and other considerations.

• Establishes new recycling collection weight targets for manufacturers: 63% by weight beginning January 1, 2025; 66% by weight beginning January 1, 2026; and 70% by weight beginning January 1, 2027.

• Requires manufacturers to describe communication efforts with state and counties for consumer education in their recycling plans, and requires collectors to report detailed information about recyclers and refurbishers used, with the Department of Health authorized to request bills of lading and receiving reports.

• Directs the Department of Health to report to the Legislature by 2028 on electronic device collection weights and whether existing manufacturer recycling obligations should be amended.
