SB 1315 Summary

• Abolishes joint and several liability for government entities in claims relating to highway maintenance and design, including guardrails, utility poles, street signs, and similar highway-related devices.

• Limits government entity liability to only the percentage share of damages directly attributable to that entity under chapter 663, Hawaii Revised Statutes.

• Removes the exception previously retained in section 663-10.9 that allowed joint and several liability specifically for highway-related tort claims.

• Does not affect rights, duties, penalties, or proceedings that began before the effective date.

• Becomes effective July 1, 2050.
