S.B. 1397 Summary

• Allows the governor discretion to delay filling a state senate or state representative vacancy if it occurs 120 days or less before the next primary election.

• Governor must appoint a replacement no later than seven calendar days following certification of the primary election results by the chief election officer.

• Amends Section 17-3 (state senator vacancies) and Section 17-4 (state representative vacancies) of Hawaii Revised Statutes.

• Applies notwithstanding any other law and takes effect upon approval.
