SB 1460 Summary

• Requires lease extensions approved by the Board of Land and Natural Resources to be drafted using the most current approved lease form and incorporate current board leasing practices and policies.

• Establishes that when a lease extension creates conflicts between updated lease terms and existing lease terms, the updated terms authorized under Chapter 171 shall control.

• Applies to all leases issued under Chapter 171 regardless of whether they were issued by public auction or direct negotiation, including agricultural, commercial, industrial, resort, and residential leases.

• Removes provisions requiring board rules to set forth additional lease terms and conditions, instead requiring use of standardized current lease forms as the mechanism to ensure consistent leasing practices.

• Takes effect upon approval and does not affect rights, duties, or leases fully executed before the effective date.
