S.B. 1493 Summary

• Requires sellers or providers of emotional support animals to provide written notice stating that the animals lack special training to qualify as service animals, are not entitled to legal accommodations of service animals, and misrepresenting them as service animals is unlawful.

• Requires persons issuing verifications of disability-related need for emotional support animals to provide written notice clarifying that the verification cannot establish an animal as a service animal and that misrepresentation is unlawful.

• Requires sellers or providers of certificates, vests, or identification tags for emotional support animals to provide written notice that such items do not establish the animal as a service animal or entitle the user to service animal rights.

• Requires all written notices to be in at least twelve-point bold type on the receipt or attached separately to the receipt.

• Establishes civil penalties of $100-$250 for first violation and minimum $500 for second and subsequent violations for failure to provide required notices; effective July 1, 2050.
