S.B. 356 Summary

• Requires sentencing courts to order defendants convicted of operating a vehicle under the influence (section 291E-61) or causing death by vehicle (section 707-702.5) to pay financial support to minor children of victims until age 18, or 19 if still in high school.

• Court must consider child's financial needs, resources, standard of living, educational needs, custody arrangements, and caregiver expenses when determining reasonable support amounts.

• Payments made to court clerk who must deposit within one business day and remit to disabled parent, surviving parent, or legal guardian within three working days.

• Provides that incarcerated defendants have up to one year after release to begin payments, and arrearages continue until fully paid.

• Defines "disabled" to include functional inabilities from psychological, psychiatric, or stress-related trauma affecting ability to make informed decisions about health, safety, food, shelter, clothing, or personal hygiene.
