SB 419 Summary

• Requires all motor vehicle insurance policies to cover the replacement cost of child passenger restraint systems damaged or in use during motor vehicle accidents where liability coverage applies.

• Obligates insurers to ask claimants whether a child safety seat was in use or present during an accident and to either replace the system or reimburse the cost of a new one.

• Defines "child passenger restraint system" as any restraint system conforming to Hawaii Revised Statutes section 291-11.5.

• Allows insureds to surrender damaged child safety seats to the Department of Transportation after obtaining replacements.

• Effective date: July 1, 3000.
