S.B. 463 - Hawaii Kratom Consumer Protection Act

• Establishes the Hawaii Kratom Consumer Protection Act, requiring all kratom products sold in Hawaii to be registered with the Department of Health beginning January 1, 2026.

• Prohibits kratom products with 7-hydroxymitragynine levels exceeding 2% of alkaloid composition, those containing synthesized materials, dangerous psychoactive compounds, or forms designed to attract children (shapes resembling cartoons, animals, or branded candy).

• Requires kratom product manufacturers to obtain certificates of analysis from ISO/IEC 17025 accredited laboratories confirming compliance with residual solvent limits, contaminant standards, and alkaloid content specifications.

• Mandates specific labeling on all kratom products including warnings against use by persons under 18, pregnant individuals, and those breastfeeding; statements that products may be habit-forming; and disclosure of mitragynine and 7-hydroxymitragynine content per serving.

• Establishes criminal penalties including class C felony charges for selling kratom products containing controlled substances or synthesized materials, and misdemeanor charges for knowingly selling to minors (on second or subsequent offense within one year).
