HI SB544

Creates new sentencing discretion for courts when sentencing adults convicted for offenses committed while under age 18, allowing departure from mandatory minimums and sentencing enhancements.

Requires courts to consider six specific factors: adverse childhood experiences and trauma, human trafficking or abuse victimization, differences between minor and adult offenders, peer or familial pressure, intellectual capacity and mental health conditions, and other relevant factors.

Permits courts to reduce mandatory minimum incarceration periods or depart from mandatory sentencing enhancements if determined warranted based on the defendant's age, trauma history, and rehabilitation prospects.

Defines "minor" as any person under 18 years of age at time of offense.

Takes effect upon approval.
