SB 615 Summary

• Amends Hawaii Revised Statutes Section 103D-501 to restrict change orders that increase contract costs by more than 50% of the original contract price or substantially change the scope of work, treating such change orders as new procurements.

• Allows documented actual costs method for change orders not exceeding 50% of total contract price and not exceeding $50,000, with 20% overhead and profit for contractor and 10% for subcontractors.

• Requires unilateral change orders exceeding $50,000 but not exceeding 50% of total contract price to be issued within 10 days, with contractors able to file a notice of intent to claim within 30 days if they disagree.

• Permits purchasing agency heads to approve otherwise-prohibited change orders if they provide written justification that such approval is in the best interest of the State.

• Takes effect on July 1, 2025.
