SB 683 Summary

• Prohibits the manufacture, sale, offer for sale, distribution for sale, and distribution for use of food packaging, food service ware, cosmetics, and personal care products containing intentionally added PFAS (perfluoroalkyl and polyfluoroalkyl substances) beginning January 1, 2028.

• Defines "intentionally added PFAS" as PFAS that manufacturers have intentionally added to products with a functional or technical effect, excluding hydrofluoroolefins used as propellants in cosmetics and products regulated as drugs, medical devices, or dietary supplements by the FDA.

• Defines food service ware to include containers, bowls, clamshells, plates, trays, cups, straws, utensils, napkins, and similar single-use items designed for prepared foods.

• Repeals the existing food packaging PFAS prohibition (Section 321-602) that was set to take effect December 31, 2024, replacing it with the broader prohibition that takes effect January 1, 2028.

• Takes effect upon approval, with the repeal of prior PFAS food packaging restrictions effective January 1, 2028.
