Urges the Department of Health to ensure incinerator ash from waste management facilities is treated as solid waste subject to control under Hawaii Revised Statutes chapter 342H, part II

Notes that the Covanta Honolulu Resource Recovery Venture (H-POWER) incinerator in Campbell Industrial Park burns up to 3,000 tons of waste daily and produces approximately 30 tons of ash per 100 tons of trash incinerated

Expresses concern that EPA toxicity tests for incinerator ash only assess groundwater contamination risks and fail to consider inhalation, ingestion, and dermal contact hazards, leading to potentially dangerous ash being classified as non-hazardous

Notifies the City and County of Honolulu that "recycling" or "reuse" of incinerator ash is not protective of public health, may violate state law, and should not be pursued

Requires transmission of certified copies to the Governor, Director of Health, Chief Energy Officer, and Mayor of Honolulu
