Employees separating from State, legislative, or county employment may transfer accrued vacation and sick leave if rehired by the State or any county government within one calendar year of separation.

The Department of Human Resources Development, both legislative houses, and each county must adopt rules, policies, or ordinances to implement the leave transfer provisions.

The definition of "break in service" for Hawaii Employer-Union Health Benefits Trust Fund contributions is extended from 90 calendar days to one full year for separations beginning on or after July 1, 2026.

"Employee" is defined as a person eligible to participate in the Employees' Retirement System of the State of Hawaii under section 88-21.

The Act takes effect on July 1, 2026, and does not diminish any more favorable transfer provisions in existing collective bargaining agreements.
