Upgrades first-offense "highly intoxicated" DUI from a petty misdemeanor enhancement to a standalone misdemeanor with minimum 5-10 days imprisonment, fines of $500-$2,000, and 18-24 month license revocation.

Elevates repeat "highly intoxicated" DUI (within 10 years of prior conviction) to a class C felony with up to 5 years imprisonment or 4 years probation with minimum 30 days jail time.

Requires mandatory ignition interlock device installation on all vehicles operated by offenders during the revocation period, along with substance abuse rehabilitation programs of 14-36 hours.

Imposes fines of $2,000-$5,000 for repeat highly intoxicated offenders, with surcharges deposited into the neurotrauma and trauma system special funds.

Excludes highly intoxicated DUI offenses under new paragraphs (4) and (5) from eligibility for deferred acceptance of guilty plea programs.
