Lowers Hawaii's legal blood alcohol concentration (BAC) threshold for operating a vehicle under the influence from .08 to .05 grams per 100 milliliters of blood or per 210 liters of breath.

Amends the definition of "measurable amount of alcohol" to cover BAC levels between .02 and .05 (previously .02 to .08).

Updates administrative revocation procedures so that drivers testing below .05 BAC will have their license returned and proceedings terminated with prejudice.

Applies the new .05 threshold to both standard DUI offenses and habitual DUI offenses under Hawaii Revised Statutes sections 291E-61 and 291E-61.5.

Takes effect upon approval, with existing rights, duties, penalties, and proceedings begun before the effective date unaffected.
