Requires the Hawaii Medical Board to establish standards for health care providers to ensure patient consent to treatment is informed consent, changing from permissive ("may") to mandatory ("shall")

Mandates that informed consent must be obtained before the day a proposed medical or surgical treatment or diagnostic/therapeutic procedure takes place

Allows informed consent to be obtained at the time of scheduling if the treatment or procedure is scheduled for the same day it will occur

Permits a confirmation of previously obtained informed consent to be gathered by the treating health care provider on the day of the treatment or procedure

Maintains existing exceptions for emergency treatment when obtaining consent is not reasonably feasible without adversely affecting the patient's health
