Establishes a legal right for individuals not under arrest or in custody to record law enforcement activities and maintain possession of their recordings and recording devices.

Prohibits law enforcement officers from interfering with lawful recording, including preventing recording, threatening recorders, commanding them to stop, or seizing their devices or recordings.

Creates a private right of action allowing individuals to sue for violations, with available remedies including punitive damages, declaratory and injunctive relief, and attorney's fees.

Provides an affirmative defense for officers who had probable cause to arrest the recorder for crimes involving obstruction of government operations under chapter 710.

Sets a three-year statute of limitations for bringing civil actions under this new chapter.
