Retail plant sellers in Hawaii must label each plant with information on its invasiveness risk based on the Hawaii-Pacific weed risk assessment, including a link to the plant pono program website.

The Invasive Species Council must develop a universal color-coded labeling system ranging from "Least Invasive" to "Most Invasive" for display on all plants sold.

Noncommercial plant growers are exempt from the labeling requirements.

Violations carry a civil fine of at least $100 per offense.

Effective date is January 1, 2027.
