Creates a new misdemeanor offense for intentionally or knowingly urinating or defecating in public places, including streets, sidewalks, parks, parking lots, and businesses open to the public

First offense punishable by a fine of $500-$1,000 or 48 hours of community service; second offense by $750-$1,500 fine or 72+ hours community service; third or subsequent offense by $1,000-$2,000 fine or 120+ hours community service

Exempts individuals with a medical condition verified by a licensed physician that prevented them from using a restroom

Requires arresting officers to contact Hawaii CARES 988 when a person arrested for this offense identifies as experiencing homelessness, triggering a mandatory mental health screening and supportive services

Takes effect upon approval
