Raises the age threshold for enhanced assault penalties against elderly victims from 60 years to 65 years of age or older

Imposes strict liability for the victim's age in assault cases, meaning prosecutors no longer need to prove the defendant knew or should have known the victim was 65 or older

Assault in the first degree (causing substantial bodily injury to a person 65+) remains a class B felony

Assault in the second degree (causing bodily injury to a person 65+) remains a class C felony
