Establishes the legal right for persons not under arrest or in custody to record law enforcement activities and maintain custody of their recordings and recording devices

Defines "law enforcement activity" as any activity by an officer acting under color of law, and "record" as capturing images, sound, or written notes through any device

Creates a private right of action against officers who interfere with recording by preventing recording, threatening recorders, commanding them to stop, arresting them for recording, or seizing/destroying recordings or equipment

Allows successful plaintiffs to recover punitive damages, declaratory and injunctive relief, and reasonable attorney and expert witness fees

Provides an affirmative defense for officers who had probable cause to arrest the recorder for obstruction crimes under chapter 710, with a three-year statute of limitations for claims
