Prohibits businesses in Hawaii from distributing, selling, or using single-use plastic food ware containing regulated per- and polyfluoroalkyl substances (PFAS) beginning January 1, 2028.

Food ware covered includes cups, lids, straws, utensils, plates, bowls, clamshell containers, and other food/beverage packaging items.

PFAS is defined as intentionally added substances or presence at or above 100 parts per million measured in total organic fluorine.

Violating businesses will be ordered to discontinue prohibited activities and face fines of $100 to $1,000 per day for continued violations, with the Department of Health handling enforcement.

Counties may enact more stringent local ordinances regulating PFAS in single-use plastic food ware.
