Bans the sale, offer for sale, or distribution of disposable electronic smoking devices in Hawaii beginning January 1, 2027

Defines disposable electronic smoking devices as non-refillable products with non-rechargeable batteries used to aerosolize and deliver nicotine or other substances, intended to be discarded after use

Exempts devices authorized for sale by a marketing order from the U.S. Food and Drug Administration under 21 U.S.C. section 387j

Establishes that selling up to 20 disposable devices constitutes a single violation, with fines to be determined per day of violation

Addresses environmental concerns including hazardous waste from lithium-ion batteries, plastic pollution, landfill fires, and toxic chemical leaching into waterways
