Health insurance carriers must honor written assignments of benefits from patients directing payment for substance use disorder treatment services directly to the treating provider, with payments due within 30 days of receiving a qualifying claim.

Insurance policies cannot contain anti-assignment clauses that prohibit, restrict, or void a patient's assignment of benefits to substance use disorder treatment providers; any such clauses are unenforceable.

Violations constitute unfair or deceptive acts or practices under Hawaii insurance law, with the Insurance Commissioner authorized to adopt rules and take enforcement action.

Insurers must provide explanation of benefits to assigned providers upon request when presented with valid authorization complying with HIPAA requirements.

Applies to fully insured health benefit plans under state jurisdiction, excluding self-funded ERISA plans unless federal law permits; effective January 30, 2050.
