Lowers Hawaii's blood alcohol concentration (BAC) threshold for driving under the influence from 0.08 to 0.05 grams of alcohol per 100 milliliters of blood or per 210 liters of breath.

Amends the definition of "measurable amount of alcohol" to the range of 0.02 to less than 0.05 (previously 0.02 to less than 0.08).

Establishes that BAC of 0.02 or less creates a presumption the driver was not under the influence; levels between 0.02 and 0.05 may be considered with other evidence but do not create a presumption.

Applies the new 0.05 threshold to both standard DUI offenses and habitual DUI offenses under Hawaii Revised Statutes sections 291E-61 and 291E-61.5.

Takes effect upon approval, with provisions ensuring the amended DUI sections are not repealed when related statutes are reenacted on June 30, 2028.
