Establishes a legal right for persons not under arrest or in custody to record law enforcement activities and maintain custody of their recordings and recording devices

Protects individuals who are arrested from forfeiting recordings made prior to arrest and requires return of recording property and instruments

Creates a private right of action allowing individuals to sue when law enforcement officers interfere with recording, including by preventing recording, making threats, seizing equipment, destroying recordings, or copying recordings without consent

Allows courts to award punitive damages, declaratory and injunctive relief, and reasonable attorneys' and expert witness fees to prevailing plaintiffs

Sets a three-year statute of limitations for filing claims, with an affirmative defense available if the officer had probable cause to arrest for crimes under chapter 710 (offenses against public administration)
