Establishes that scholarships, tuition waivers, and free enrollment at private pre-K through 12th grade schools are legally classified as conditional gifts rather than contractual obligations, unless parties explicitly agree otherwise in writing

Allows donors and schools to impose reasonable conditions on educational awards, including academic performance minimums, conduct standards, and enrollment requirements, with continuation contingent on meeting those conditions

Protects donors and schools from contractual claims when educational awards are modified or terminated for failure to meet specified conditions, provided conditions are applied consistently with award terms and applicable law

Permits schools to require students or parents to pay for optional extracurricular items, sign waivers, or allow non-commercial use of student name/image without creating a contractual relationship

Applies only to donor-conditioned educational awards and school-conditioned enrollments made on or after the Act's effective date
