Shifts responsibility for conducting background checks from the department to applicants, operators, and third-party employers (such as staffing agencies and contractors), who must obtain and maintain documentation of completed checks.

Requires fingerprint-based background checks for prospective employees and volunteers, with exemptions for individuals already fingerprinted for licensure, volunteers who complete other required checks, and staff with only incidental patient access.

Prohibits healthcare facilities from employing or permitting individuals to work until background checks are complete and no disqualifying information is found, including convictions for relevant crimes or findings of patient abuse.

Delays fingerprint-based background check requirements until July 1, 2028, while requiring all other background check elements (name-based criminal history inquiries and registry checks) to continue immediately.
