Discovery depositions are prohibited in criminal cases when the victim is a minor at the time of the deposition and has already provided a video and audio recorded statement describing the charged offense.

The recorded statement must be obtained by a forensic interviewer employed by an accredited child advocacy center or child protection center.

The interview must be conducted substantially in accordance with a nationally recognized protocol for interviewing children.

Courts may still permit discovery depositions of minor victims upon application and a showing of exceptional circumstances.
