Forfeited weapons and ammunition from serious misdemeanors, aggravated misdemeanors, or felonies must be deposited with the Iowa Department of Public Safety for disposal according to department rules.

Forfeited firearms and ammunition that are legal and not classified as offensive weapons may be sold by the department, or released to law enforcement agencies upon application and in accordance with department rules.

The Department of Public Safety is required to conduct an annual audit of all forfeited weapons received, including documentation of each weapon's use and location.

Weapons may continue to be held for law enforcement use, testing, or comparison by the criminalistics laboratory, or destroyed.
