Covers false claims about the existence of polling data, collection of survey responses, use of scientific methodology, and the source/sponsorship of purported polling results

Establishes escalating penalties: serious misdemeanor for first offense, aggravated misdemeanor for second offense, and class "D" felony for third or subsequent offenses

Provides for forfeiture of fraudulently obtained funds and creates a private cause of action allowing victims to seek actual damages, treble damages for knowing misconduct, and attorney fees

Exempts opinions, predictions, advocacy, disclosed internal campaign surveys, clearly labeled informal polls, and good-faith methodological disagreements from prosecution
