Allows applicants before the Iowa Utilities Commission or property owners subject to eminent domain taking claims to petition the Polk County District Court for declaratory review of constitutional and statutory eminent domain provisions prior to final commission action

Permits property owners to commence a new action in a different county with a different judge if more than 18 months have passed since the prior action began, or if facts and circumstances have materially changed since the previous proceeding

Requires new proceedings to be reviewed de novo, with no precedential value given to determinations made in earlier actions

Imposes a $10 filing fee payable to the district court clerk, with fees deposited into the state general fund

Prohibits bond requirements for appeals of any order entered in these declaratory actions or for injunctions to enforce such orders
