Magistrates must set bail at or above the uniform bond schedule amount, with any deviation below requiring written justification pursuant to section 811.2, subsection 2.

Release on personal recognizance is restricted to defendants charged with nonviolent, non-drug simple or serious misdemeanors only.

The bond schedule cannot be used for arrests involving domestic abuse assault (section 708.6), felon in possession of a firearm (section 724.26), or forcible felonies.

When courts are not in session, judges or magistrates may still order release but must provide written justification for any conditions of release that deviate from standard requirements.

Defendants released prior to initial appearance must have that appearance scheduled within 30 days of release, and the bond schedule exception does not apply to methamphetamine manufacturing or distribution charges.
