Prohibits persons who cannot demonstrate sufficient English proficiency from operating commercial motor vehicles, with violations classified as a serious misdemeanor carrying a mandatory $1,000 fine and potential imprisonment up to one year.

Prohibits commercial motor carriers from employing or engaging drivers (including independent contractors) who lack English proficiency, with violations constituting a serious misdemeanor plus escalating civil penalties: $3,000 (first), $5,000 (second), $10,000 (third or subsequent).

Requires carriers to pay the civil penalty and provide an English-proficient replacement driver within 12 hours of a violation stop, or cargo owners may arrange transfer of goods to another vehicle.

Includes a federal compliance exception allowing the department to disregard provisions that would result in denial of federal funds or services or otherwise violate federal law.
